Spruce Collective (“Spruce Collective”, “we”, “our” or “us”) respects your privacy. This Privacy Policy describes the types of information we may collect from you when you visit www.rootedwithspruce.com (the “Website”) and purchase our products and/or use services offered via the Website (the “Services”), how we use the information we collect, with whom we share it, how we protect it, and the choices we offer you regarding our collection and use of such information. Device information
Examples of Personal Information collected: version of web browser, IP address, time zone, cookie information, what sites or products you view, search terms, and how you interact with the Site.

Automatic Decision Making
If you are a resident of the EEA, you have the right to object to processing based solely on automated decision-making (which includes profiling), when that decision-making has a legal effect on you or otherwise significantly affects you.
We DO NOT engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.
Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.
Services that include elements of automated decision-making include:
Temporary denylist of IP addresses associated with repeated failed transactions. This denylist persists for a small number of hours.
Temporary denylist of credit cards associated with denylisted IP addresses. This denylist persists for a small number of days.

Your Personal Information will be initially processed in Ireland and then will be transferred outside of Europe for storage and further processing, including to Canada and the United States. Cookies
A cookie is a small amount of information that’s downloaded to your computer or device when you visit our Site. Terms and Conditions
Training Subscriptions and Cancellations
All subscriptions are auto-payments that renew every month until canceled via the policies below. To cancel your training subscription, you must email “CANCEL” to sarah@rootedwithspruce.com. Cancellations are not accepted in person or via TrueCoach app. Cancellation requests must be received at least two weeks before the next bill cycle in order not to be charged another month.
PLEASE NOTE: There are no refunds on any subscription option. All sales are final sale.
Returns
Subscriptions are not valid for return. To cancel your subscription, you must email Sarah at sarah@rootedwithspruce.com at least two weeks before your next bill cycle.
Participation in Training (Physical Activity)
The program is voluntary and the Personal Trainer, Sarah Kincart, will develop and guide participants through nutrition and/or exercise program(s) remotely. The online nutrition and exercise guides are designed for those individuals who do not have certain medical limitations regarding diet/exercise. If the participant’s medications, condition, or medical limitations should change during the program, they must notify the Trainer. It is recommended that participants have a yearly physical or more frequent physical examination and consultation with their physician as to physical activity and diet, so they are aware of what is appropriate for them. Participants acknowledge that they have either had a physical exam and have been given a physician’s permission to participate or have decided to participate without the approval of a physician.
The trainer is not a physician and cannot replace the advice and expertise of a physician.
The trainer may include recommended nutrition guidance to better meet my fitness goals. The trainer is a nutrition coach, not a nutritionist or registered dietician (RD), and she is legally not allowed to prescribe a specific meal plan for me. Any specific diet limitations need to be discussed with a physician, nutritionist, or RD to ensure proper monitoring.
Participants have the complete right to stop or decrease exercise at any time during a workout, and it is their obligation to notify a physician or seek medical attention immediately if they develop any symptoms such as fatigue, shortness of breath or chest discomfort.
Participation in the program includes but not limited to exercising, use of exercise equipment, and strenuous exertion (strength training) all of which increase heart rate and body temperature.
Exercise involves certain risks, including but not limited to, serious neck and spinal injuries resulting in complete or partial paralysis, heart attack, stroke, or even death. Also, injuries could occur to bones, joints, or muscles. Slips, falls, and unintended loss of balance could result in muscular, neurological, orthopedic, or other bodily injury. Part of the risk involved in undertaking any activity or program is relative to the participant’s own state of fitness or health (physical, mental, or emotional) and to the awareness, care, and skill which they conduct themselves in that activity or program.
Knowing the material risks and appreciating, knowing, and reasonably anticipating that other injuries are a possibility, the participant hereby expressly assumes all of the delineated risks of injury, all other possible risk of injury, and even risk of possible death, which could occur by reason of participation.
Participants hereby waive, release, and forever discharge to their Trainer, Sarah Kincart, from any and all responsibilities or liability for any present and future injuries or damages resulting or arising from my participation in any activities including but not limited to use of the nutrition guide, exercise, personal training or use of the equipment including any injuries and damages caused by the negligent act or omission of any of those persons or entities mentioned above.
